A. GENERAL TERMS AND CONDITIONS

1. Scope
1.1 These terms and conditions of "Metz mobility GmbH" (hereinafter "Seller") apply to all contracts concluded between a consumer or entrepreneur (hereinafter "Customer") and the Seller regarding the goods and/or services presented by the Seller in its online shop. The inclusion of the Customer's own terms and conditions is hereby excluded, unless otherwise agreed.

1.2 A consumer within the meaning of these General Terms and Conditions is any natural person who enters into a legal transaction for a purpose that cannot be attributed to their commercial or independent professional activity. An entrepreneur within the meaning of these General Terms and Conditions is any natural or legal person or a partnership with legal capacity who, when entering into a legal transaction, acts in the exercise of their independent professional or commercial activity.

2. Conclusion of Contract
2.1 The presentation of products in the online shop does not constitute a legally binding offer, but rather a non-binding online catalog. By clicking the order button, you place a binding order for the goods in your shopping cart. Confirmation of receipt of your order will be sent by email immediately after you submit the order and does not constitute acceptance of the contract.

2.2 We can accept your order by sending a declaration of acceptance in a separate email or by delivering the goods within two business days, whereby receipt by the customer is decisive. If working days are specified as deadlines, this means all weekdays with the exception of Saturdays, Sundays, and public holidays at our headquarters in Trautskirchen (Germany).

2.3 A binding contract can also be concluded beforehand as follows:

If you have chosen to pay in advance, the contract is concluded by the immediate dispatch of the order confirmation by email or by a request for payment in the online shop.
If you have chosen PayPal as your payment method, the contract is concluded at the time you confirm the payment instruction to PayPal.
If you have chosen credit card as your payment method, a binding contract is only concluded once Stripe has accepted you as a customer after a thorough review.

4. Prices and Payment Terms
4.1 The prices stated by the seller are final prices and include statutory German sales tax. Any additional delivery and shipping costs will be stated separately in the respective product presentation in the offer.

4.2 For deliveries within Germany, the seller offers the following payment options, unless otherwise stated in the respective product presentation in the offer: PayPal or credit card.

4.3 If shipping abroad is also offered for the respective item, the customer has the following payment options for deliveries abroad, unless otherwise stated in the respective product presentation in the offer: PayPal or credit card.

For deliveries to countries outside the European Union, additional costs may arise in individual cases for which the seller is not responsible and which must be borne by the customer. These include, for example, costs for money transfers through credit institutions (e.g., transfer fees, exchange rate fees) or import duties or taxes (e.g., customs duties).

4.4 If advance payment has been agreed, payment is due immediately after conclusion of the contract. When paying via PayPal or credit card, the invoice amount will be debited immediately after clicking the "Order with payment" button at the end of the ordering process.

5. Delivery and Shipping Conditions
5.1 Goods are usually delivered by post to the delivery address provided by the customer. The delivery address provided by the seller during the purchase process is decisive for the processing of the transaction. By way of derogation from the above, if PayPal is selected as the payment method, the delivery address provided by the customer to PayPal at the time of payment shall be decisive.

5.2 Unless otherwise stated on the product page, all products are available for immediate delivery.

5.3 The seller offers the following delivery methods: Standard delivery (UPS). Other delivery methods are available only upon individual request. Other delivery methods incur additional costs, which are to be borne by the buyer.

5.4 The price information (with the exception of any special offers specifically indicated) includes the addition: "plus shipping costs." The word "Shipping costs" is provided as a button or link, which takes the user to an overview of the shipping costs. The exact shipping costs are specified in the order. You will be informed of this during the ordering process before completing the order process.

5.5 The delivery time is 3-8 working days.

5.6 If not all ordered products are in stock, we are entitled to make partial deliveries at our own expense, provided this is reasonable for you.

5.7 If delivery of the goods fails due to your fault despite three delivery attempts, we may withdraw from the contract. Any payments made will be refunded immediately.

5.8 If goods are delivered with obvious transport damage, please report such defects immediately to the delivery person and contact us as soon as possible (sales@metz-mobility.de / +49 911 / 9 7536-90).

5.9 Failure to file a complaint or contact us will have no consequences for your statutory warranty rights. However, you will help us assert our own claims against the carrier or transport insurance.

6. Liability for Defects
The statutory liability for defects applies.

7. Applicable Law
7.1 The law of the Federal Republic of Germany shall apply to all legal relationships between the parties, excluding the laws governing the international sale of movable goods. For consumers, this choice of law shall apply only to the extent that the protection granted is not withdrawn by mandatory provisions of the law of the country in which the consumer has their habitual residence.

7.2 If the customer acts as a merchant, a legal entity under public law, or a special fund under public law, the exclusive place of jurisdiction for all disputes arising from this contract shall be the seller's place of business. The same applies if the customer does not have a general place of jurisdiction in Germany or the EU, or if their place of residence or habitual residence is unknown at the time the action is filed. The right to also bring the dispute before a court at another statutory place of jurisdiction remains unaffected.

7.3 The contractual language is German.

8. Retention of Title
The goods remain our property until full payment has been made. Before ownership is transferred, pledging, transferring ownership by way of security, processing, or modification is not permitted without our consent.

9. Warranty
The warranty is provided in accordance with statutory provisions.

10. Final Provisions
Should any provision of these General Terms and Conditions be invalid, the remainder of the contract shall remain valid. The relevant statutory provisions shall apply in place of the invalid provision.

The essential characteristics of the goods or services can be found in the respective product description provided by the Seller.

3. Information on the Conclusion of the Contract
The contract is concluded in accordance with Section 2 of the Seller's General Terms and Conditions (see above).

4. Information on Payment and Delivery
Payment is made in accordance with Section 4, and delivery is made in accordance with Section
5 of the Seller's General Terms and Conditions (see above).

5. Information about the technical steps leading to the conclusion of the contract
The contract is concluded through offer and acceptance:

5.1 If the customer uses the seller's online order form to place their order, they submit their offer as follows:

5.1.1 On the seller's product offer page, the customer first clicks on the "Add to Cart" button. This will automatically open the "Shopping Cart" window with an overview of all products in the shopping cart.

5.1.2 The customer can now either return to the online shop via the menu under "Metz moover Online Shop" and add another product to the shopping cart if necessary, or continue shopping in the existing shopping cart by clicking on "Continue to Checkout."

"Shipping Address": Enter the billing and delivery address. On this page, the customer enters their billing and delivery address and also has the option of entering a different delivery address. They then click the "Continue" button.

"Order Summary": Overview of the ordered goods, shipping costs including estimated delivery time, and the total amount.

"Payment": Select payment method. A new page opens where the customer receives an overview of the available payment methods. Under the payment methods, there is an overview of the order to be placed and confirmation of the Terms and Conditions as well as their right of withdrawal. By clicking the "Buy" button, the customer places their order.

5.2 Acceptance by the seller takes place gt in accordance with Section 2.3 of the Seller's General Terms and Conditions (see above).

6. Information on the Storage of the Contract Text
The contract text will be stored by the Seller and sent to the Customer after the order has been submitted, along with these General Terms and Conditions and customer information, in text form (e.g., by letter, email). The contract text can be accessed by the Customer after the order has been submitted via the Seller's website.

7. Information on the Technical Means for Detecting and Correcting Input Errors
Before submitting the order, the Customer can continuously correct their input using the usual keyboard and mouse functions. In addition, all inputs will be displayed again in a confirmation window before the order is submitted, and can also be corrected there using the usual keyboard and mouse functions.

8. Information on the Languages Available for Contract Conclusion
The German language is the only language available for contract conclusion.
